Typically, any aircraft that is maneuvering, or perceived to be maneuvering, in an unnatural or unordinary manner is believed to be unsafe. This raises concerns from persons on the ground. In reality, most aircraft operation is quite safe and legal. Airplanes are required to maintain 500 feet of distance—either above or horizontally from any persons or structures in sparsely population areas. In densely populated areas, the required distance is 1000 feet. Helicopters are allowed to operate with less clearance. It is rare that the noise generated from one aircraft overflight would exceed the legal noise limits for an area; however, accumulated overflight noise may become an annoyance. In these cases, the airport may be notified and an attempt will be made to identify the aircraft.

Flight schools are operated as individual businesses on the airport. Typically, the student rents the training aircraft and hires the certified Flight Instructor as a package. The Private Pilot license first requires training 40 hours total time—20 hours with an instructor (dual), 20 hours without (solo), with ground training also required. Ultimately, in order to obtain a license, the prospective pilot must pass a test administered by the FAA.

The City general plan and zoning map provide for building allowances within city limits. The Airport Master Plan identifies compatible land uses for all areas within the immediate vicinity of the airport including those outside City limits. It outlines the requirements for construction, the allowable densities for building and people in specific areas, and the types of uses that are compatible with airport operations, noise and safety concerns.

An Avigation Easement is a legal document granted by the property owner, signifying that notification was given regarding the airport in the vicinity, that the airport produces noise and annoyances and that it is accepted. The easement is recorded with the County Clerk-Recorder and is attached to a property deed. The easement provides protected airspace and aircraft operating areas above the subject property.

There is land available for lease—both aviation and industrial developments, Airport property is not sold. The process begins with a written Letter of Intent to the City. Once the proposal is “first-in-line” for a parcel, the proposal process continues with a Development Application, a Development Plan, and the negotiation process for a long-term lease. A standard lease may be 20 years, possibly with options to renew. Rental rates are based on the fee simple appraised value of the land with annual escalations coupled to CPI. The Delano Municipal Airport is an uncontrolled airfield offering a 5,651-foot runway and light aviation services and is open to the public. There are twenty-four 100LL fuel sales are available by card lock system, and take most major credit cards. The Airport Maintenance Aide sells oil. The Terminal features wi-fi access, a television, computer to download flight plans and an attendant to provide customer service assistance. Enterprise Rent A Car office is approx 2 miles away and they will pick you up.

Residential projects need 2 sets of builing plans, including floor plans and elevations (side views) with dimensions clearly labeled, a Site Plan that clearly shows distances of the existing and proposed building from property line. Plan check fee is required upon submittal of plans. Commercial Projects need 5 sets of builind plans, 2 sets of structural calculations or Title 24. Plan check fee is required upon submittal of plans.

Code Enforcement

You may make contact with the property owner directly and request that he resolve the violation, or you may report violations of the above codes to the Code Enforcement Officer by calling (661) 720-3324,or by emailing your complaint to the email found at the bottom of this section. When submitting a complaint, the reporting party must include their name and phone number, as anonymous complaints will take longer to be processed. When processing a complaint, we do not provide the violator with the information about who reported the alleged violation. Additional information which must be provided is a description of what the alleged violation is, the location of the violation including the nearest cross-street and any other pertinent information which may be helpful.

The City of Delano is not a referee for tenant-landlord disputes. Generally these disputes are best resolved between the renter and property owner. The General Rule for maintenance of rented properties as presented by the State of California Department of Consumer Affairs is: "When a landlord rents an apartment or a house to a tenant (renter), the rented property must be fit to live in. In other words, the rented property must be "habitable." During the time that the property is being rented, the landlord must do maintenance work and make repairs which are necessary to keep it habitable. However, the landlord is not responsible to the tenant for repairing damage caused by the tenant, or the tenant's guest, children or pets." For information about your rights and suggestions on ways to resolve housing complaints between tenants and landlords, the State of California, Department of Consumer Affairs, 400 R Street, Suite 3090 Sacramento CA 95814-6200 (800) 952-5210 has published several guidelines: LT-3, LT-6 and LT-8. . If you have contacted your landlord and they are unwilling to make the property habitable, within the limits of their responsibility, you can submit a complaint through the City of Delano Building & Safety Code Enforcement Officer.

Most likely the Code Enforcement Officer has started working with the property owner to resolve the violation. Typically the Code Enforcement Officer will notify the owner that we have received a specific complaint alleging certain violations of the Delano Municipal Code exist on his or her property. We normally request that the property owner respond to us indicating they will resolve the violation in an acceptable time frame, that the violation has been resolved or that the property was not in violation. If the owner chooses not to work with the City of Delano to cooperatively resolve the violation, we begin a more formal legal process which may take an extended time to fully resolve. We request that in most non-hazardous situations that you wait a minimum of 30 days after filing the complaint before checking on the status of a complaint to allow us time to contact the property owner and attempt resolution of the violation.

The first letter you should receive is mailed to you as a courtesy after we have received a complaint. It is intended to merely advise you that a violation of the Delano Municipal Code has been alleged. After receipt of the letter please contact the Code Enforcement Officer assigned the case at your earliest convenience to clear up any of the following: 1. The information in the letter is incorrect. 2. The violation no longer exists. 3. You don't understand some part of the letter. 4. You just need additional time to bring your property into compliance. 5. If you want to talk about your options. Once the allowable time specified on your first letter has expired, and if you have not contacted the Code Enforcement Officer, an officer will inspect your property to verify the allegations. If it is determined that the violation does not exist, the case will be closed and no further action will be taken. However, if a violation is found to exist, you will be notified by an "Official Notice To Comply." This notice will state specific code sections for which you are in violation, the remedies available to you, and any fines, charges and/or penalties that you will be assessed. Please contact the Building & Safety Department as soon as possible. We will be happy to discuss the information outlined in your notice with you and to go over any and all options available to you. Our first priority is to bring violations into compliance through voluntary measures whenever possible.

Connect CTY
|
|
The Connect-CTY service allows authorized civic leaders to create and rapidly disseminate time-sensitive messages to every telephone number stored in the notification database. With the Connect-CTY service, authorized users can send thousands of messages in minutes. Only authorized officials are allowed access to the system.

Authorized officials record a voice message that is then delivered quickly to individual phones in the notification database.
|
|
|
Any message regarding the safety or welfare of our community would be disseminated using the Connect-CTY service. Examples would include severe weather warnings and updates, hazardous traffic or road conditions inside the city or affecting local routes, and any other situation that could impact the safety, property, or welfare of our citizens.

This system is a significant enhancement to existing means of communication and is supplemental to, not a replacement for, the systems we have used in the past. The call-in emergency information line (661)-721-3424, which is activated during an emergency situation, will still be available. Also, our City web site will continue to display important announcements.

It is our intention and hope that every residence and commercial facility in our community be included in the notification database. For businesses, we only store one main phone number. For residents, we may have more than one number that belongs to you in the database. Additionally, you may request to have a secondary number be entered into our database for priority calling.

Connect-CTY® is a service of The NTI Group, Inc. (NTI). NTI takes security and privacy concerns very seriously and does not sell, trade, lease or loan any data about our clients to any third party. From a technical perspective, we utilize multiple physical and virtual layers of firewalls to maintain data security. NTI only utilizes secure transmissions with its customers. No confidential information is ever transmitted between NTI and its customers using e-mail or FTP, but rather always utilizes either a VPN tunnel or SSL. Data is hosted in state-of-the-art facilities which require photo identification, thumb-print recognition, keyed access, and are manned 24/7 with full-security personnel. All data is encrypted prior to being placed on tape for offsite storage. NTI also retains an external, independent security firm to perform annual security audits.

The caller-ID number for calls generated by the Connect-CTY service will be the same as the City Office number: (661)-721-3424. In addition, every message will begin with the same standard announcement: “Hello, this is ______ calling with an important message from the City of City of Delano Police Department”. The message content will follow this standard introduction.

For non-residents or owners who reside out of our city, you may provide an additional phone number to be included in our database to contact during certain situations. In general, calls are sent to the primary number only, but we also have the ability to call multiple numbers for each resident or business when requested by the resident or business. Repeating or looping of messages happens when the system detects excessive noise in the background. This can be caused by loud radio/television volumes, people talking, or busy traffic noise. When you receive the next call, say “hello” once and turn down the volume of your radio/television or press the mute button on your telephone to allow full message delivery.

Finance - Business Licenses
|

You may obtain a Business License Application from the Finance Department. The regular business license application is available for download. Depending on the type of business you will be conducting, you will have to show proof that you are complying with federal, state and county laws. Once you have completed the application turn it back into the Finance Department with copies of the required documentation and the pay the necessary fee. Certain businesses may take as long as four weeks for approval. Once approval has bee obtained it will take an addition two to three weeks to receive your license.

Every business conducted from a home in the City of Delano must have both a Business License and a Home Occupation Permit. All licenses expire December 31st . The renewal forms are mailed out during the first week of January and are due February 1st. You will need to provide your gross receipts for the prior year. If you do not receive your renewal in the mail, please contact our office. Failure to receive a renewal notice does not relieve the business owner of his/her responsibility in renewing the business license nor is it grounds for waiving any penalties due.

Finance - Utility Billing
|

If you are a homeowner, you will need to bring the following into our office: Proof of ownership (deed, property tax bill or mortgage payment coupon, and $25 for the deposit on the trash container. If you are a renter, bring in your lease or rental agreement. There will also be a deposit if you are renting, however the fee varies. Contact our office for the current fee. In either case, you will need to bring in a valid picture U.S. ID as well as your social security card. Your deposit will be credited towards your account after six months provided your payments are on time.

Yes. You will need to come into our office and sign up for an extension. We do not take extensions by phone. The deadline to sign up for the extension is the deadline for the delinquent bills. If you do not sign up for an extension and do not pay your bill by the delinquent due date, your services will be shut off. This is stated on the bottom of your delinquent bill.

Before service can be restored, a $50 reconnection fee plus your full balance must be paid.
|
|
|
Prior to your yard sale, come into our office or print and fill out the application from our website. You are allowed 4 yard sales a year. The first two are $5 and the last two are $10. Please be aware that it is prohibited by law to post notices on utility poles.

Pick up an application from our office. These applications must be turned into our office 5 days prior to the car wash date. You have to be sponsored by a non-profit organization. Any business location is entitled to sponsor one car wash every three months.

To make payment installments, you must come into City Hall within 21 days from the violation date and make arrangements. To contest a parking ticket, you must pay the fine in full and then request in writing an Administrative Review. This request must be submitted to City Hall either in person or by mail. Planning

You should have the street address or the Assessor Parcel Number before calling or visiting the Department. You can find the Assessor Parcel Number by looking at the latest County property tax bill for the lot, or by contacting the Kern County Tax Assessor’s office. Our staff can provide you assistance at our counter. Staff will then provide you the current zoning designation, the permitted uses, development requirements, and any land use restrictions based on the General Plan designation.

Please file complete plans at the Community Development Counter. Two sets of plans should be submitted for single family residential and second unit projects.
|
|
|
You must file an application for a “Special Events Permit” with a $35 filing fee. Please submit a site plan showing the location of the event, access from the street, and parking area. You should also list the proposed dates of the event, including set-up and take-down, and the hours of the event. A signed letter of authorization by the property owner or authorized manage of the site must also be submitted and on file. The City also requires a Certificate of Liability Insurance which lists the City of Delano as an additional insured party. An outdoor event must take place in a commercial or industrial zone in the City, except for a nonprofit organization such as a school or church. A business license must also be obtained from the City Finance Department if the applicant does not have a current license.

Police Department

The first prohibits all drivers from using a handheld wireless telephone while operation a motor vehicle. Motorists 18 and over may use a hands-free device. The second law restricts drivers under the age of 18 may NOT use a wireless telephone or hands-free device while operating a motor vehicle. Other Wireless Telephone FAQ When do the new wireless telephone laws take effect? The new laws take effect July 1, 2008 What if I need to use my telephone during an emergency, and I do not have a hands-free device? The law allows a driver to use a wireless telephone to make emergency calls to a law enforcement agency, a medical provider, the fire department, or other emergency services agency. What are the fines if I'm convicted? The base fine for the FIRST offense is $20 and $50 for subsequent convictions. According to the Uniform Bail and Penalty Schedule, with the addition of penalty assessments, a first offense is $76 and a second offense is $190. Will I recieve a point on my driver's license if I'm convicted for a violation of the wireless telephone law? NO. The violation is a reportable offense: however, DMV will not assign a violation point. Will the conviction appear on my driving record? Yes, but the violation point will not be added. Will there be a grace period when motorists will only get a warning? NO. The law becomes in effect on July 1, 2008. Whether a citation is issued is always at the descretion of the officer based upoin his or her discretion of the most appropriate remedy for the situation. Are passengers affected by this law? No. This law only applies to the person driving a motor vehicle. Do these laws apply to out-of-state drivers whose home states do no have such laws? Yes. Can I pulled over by a law enforcement officer for using my handheld wireless telephone? YES. A law enforcement officer can pull you over just for this infraction. What if my phone has a push-to-talk feature, can I use that? No. The law does provide an exception for those operationg a commercial motor truck or truck tractor (excluding pickups), implements of husbandry, farm vehicle or tow truck, to use a two-way readio operated by a "push-to-talk" feature. What other exceptions are there? Operators of an authorized emergency vehicle during the course of employment are exempt as are those motorists operating a vehicle on private property. DRIVERS 18 AND OVER Drivers 18 amd over will be allowed to use a hands-free device to talk on their wireless telephone while driving. The following FAQs apply to those motorists 18 and over. Does the new "hands-free" law prohibit you from drialing a wireless telephone while driving or just talking on it? The new law does not prohibit dialing, but drivers are strongly urged not to dial while driving. Will it be legal to use a Bluetooth or other earpiece? Yes, however you cannot have BOTH ears covered. Does the new hands-free law allow you to use the speaker phone function of your wireless telephone while driving? Yes. Does the new "hands-free" law allow drivers 18 and over to text page while driving? The law does not specifically prohibit that, but an officer can pull over and issue a citation to a driver of any age if, in the officer's opinion, the driver was distracted and not operating the vehicle safely. Text paging while driving is unsafe at any speed and is strongly discouraged. DRIVER'S UNDER 18 Am I allowed to use my wireless telephone hands free? NO. Drivers under the age of 18 may not use a wireless telephone, pager, laptop or any other electronic communication or mobile services device to speak or text while driving in any manner, even hands free. EXCEPTION: Permitted in emergency situations to call police, fire, or medical authorities. Why is the law stricter for provisional drivers? Statistics show that teen drivers are more likely then older drivers to be involved in crashes because they lack driving experience and tend to take greater risks. Teen drivers are vulnerable to driving distractions such as talking with passengers, eating or drinking, and talking or texting on wireless phones, which increase the chance of getting involved in serious vehicle crashes. Can my parents give me permission to allow me to use my wireless telephone while driving? NO. The only exception is an emergency situation that requires you to call a law enforcement agency, a health care provider, the fire department or other emergency agency entity. Does the law apply to me if I'm an emancipated minor? Yes. The restriction applies to all licensed drivers who are under the age of 18. If I have my parent(s) or someone age 25 years or older in the car with me, may I use my wireless telephone while driving? NO. you may only use your wireless telephone in an emergency situation. Will the restriction appear on my provisional license? No. May I use the hands-free feature while driving if my car has the feature built in? NO. The law prohibits anyone under the age of 18 from using any type of wireless device while driving, except in an emergency situation. Can a law enforcement officer stop me for using my hands-free device while driving? No. For drivers under the age of 18, this is considered a SECONDARY violation meaning that a law enforcement officer may cite you for using a hands-free wireless phone if you were pulled over for another violation. However, the prohibition against using a handheld wireless telephone while driving is a PRIMARY violation for which a law enforcement officer can pull you over.
